1. Platform Description
HookedLeads provides a call routing technology platform that connects inbound telephone inquiries from consumers to licensed insurance agents. HookedLeads is not an insurance company, does not employ insurance agents, does not sell insurance, and does not provide insurance advice of any kind.
2. Agent Eligibility
To use HookedLeads as an agent, you must: (a) hold a valid, active insurance license in each state for which you receive calls; (b) be legally authorized to sell life insurance products in those states; (c) maintain your license in good standing throughout your use of the platform. By creating an account, you represent and warrant that these conditions are met.
3. Agent Responsibilities
Agents are solely responsible for: compliance with all federal and state insurance regulations; maintaining active licensure; conducting all sales activities in accordance with applicable law; obtaining any required consents from consumers; and all representations made to consumers. HookedLeads bears no liability for agent conduct.
4. Call Credits and Billing
Call credits are consumed when a connected call reaches 10 seconds in duration. Credits are non-refundable once consumed. Unused credits from one-time packs do not expire. Weekly subscription credits reset each billing cycle. Credits have no cash value and are not transferable.
5. Call Recording and Monitoring
By using HookedLeads, agents consent to the recording of all calls handled through the platform for quality assurance, training, and compliance purposes. Agents acknowledge that HookedLeads discloses recording to callers at the start of each call.
6. Prohibited Conduct
Agents may not: misrepresent their licensing status; use the platform in states where they are not licensed; attempt to manipulate the credit system; share account credentials; use the platform for outbound solicitation of consumers who have not initiated contact; or violate any applicable federal or state law.
7. Termination
HookedLeads reserves the right to suspend or terminate any account immediately and without notice for violation of these Terms, misrepresentation of licensing, fraudulent activity, or any conduct that exposes HookedLeads or its users to legal liability. No refund of unused credits will be issued upon termination for cause.
8. Limitation of Liability
HookedLeads is a technology platform and is not liable for: the quality or outcome of any call; agent conduct or consumer harm; missed calls due to connectivity issues; or any indirect, incidental, or consequential damages. Our total liability to any agent is limited to the amount paid in the 30 days preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless HookedLeads, its officers, and employees from any claims, damages, or expenses (including attorney fees) arising from your use of the platform, your misrepresentation of licensing, or your violation of any law or these Terms.
10. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Hillsborough County, Florida.
